Another bill allowing for the manual backup systems was also passed, despite strong opposition from NASA
The controversial Election Laws amendment bill have been passed by the National Assembly on Wednesday, October 11.
Jomo Tv online learnt that the bill was passed after Jubilee MPs approved a report by the Joint Select Committee (JSC) which had a detailed account on the proposed amendments.
The Committee, which was tasked to oversee the implementation of Election Laws and Ammendments Bill 2017, tabled the report on Tuesday, October 10.
The Bill proposed that should a candidate withdraw from a poll, his direct competitor should be declared winner by the IEBC.
Another bill which was approved by the House was one which sought for manual backup for election results in the event electronic systems failed.
The Bill stated that "should there be any discrepancies in the electronic transmission of results, the manual results would prevail".
Baringo Member of Parliament, William Cheptumo, who is also the chairperson of the Joint Committee, told the August House that the ammendments were aimed at covering the loopholes which ultimately led to the nullification of the Presidential election by the Supreme Court .
“Where there is a discrepancy between the electronically transmitted and the physically delivered results, the commission shall verify the results and the result which is an accurate record of the results tallied, verified and declared at the respective polling station shall prevail,” Cheptumo spoke on Wednesday, October 11.
The passing of the electoral ammendments bill comes on the heels of a sensational withdrawal of NASA leader Raila Odinga from the repeat presidential poll.
Raila had previously been adamant that they would not participate in the repeat poll for several reasons, including the contentious ammendments of the electoral laws.
With the Bill being passed barely a day after Raila Odinga withdrew his candidature, the country still remains in Limbo as the amendments are yet to be assented into Law by the President.
